Police Shooting Case Headed for Trial

A federal jury in Manhattan will hear the case of the Estate of Mauricio Jaquez v. City of New York beginning on April 20, 2015. The case will be tried by attorneys Zachary Margulis-Ohnuma and Sharlene Morris of the Law Office of Zachary Margulis-Ohnuma. The complaint, which survived the City’s motion for summary judgment earlier this year, alleges that five police officers used excessive force when they shot and killed Mr. Jaquez in his apartment in the Bronx in 2009 after a two-hour standoff. Mr. Jaquez, a cook, and his wife, Ana Martinez, were raising their three children when he was killed. The family was left homeless after his death and the case was previously dismissed when Ms. Martinez did not respond to court notices. It was reinstated by the Second Circuit Court of Appeals in 2013. The trial is expected to last about two weeks.
